PUBLIC HEARING

AUGUST 6, 2008 6:00 PM

A Public Hearing was held at 6:00 PM at 102 Arthur Avenue, Lake Arthur, Louisiana for the purpose of hearing questions or comments for introduced Ordinance No. 521, An Ordinance Authorizing the Public auction of Surplus Property belonging to The Town of Lake Arthur.

Present at the public hearing was Mayor Giles; Council Members David Hanks, Cindy LaPoint, Dorothy Charles, and Ellsworth Duhon; Town Attorney Bennett LaPoint; Town Clerk Cynthia Mallett; representative of the Lake Arthur Sun Times, Lake Charles American Press, and the Jennings Daily News; and about 3citizens. Mayor Giles read the title of Ordinance No. 521 and asked if there were any questions or comments. No questions or comments were made.

Mayor Giles closed the public hearing at 6:03 pm.

REGULAR MEETING

AUGUST 6, 2008 6:03 PM

The Mayor and Board of Council Members of the Town of Lake Arthur met this day in regular meeting. Notice of the meeting was duly exercised as per requirements of open meeting law and special meetings.

Council Member, Dorothy Charles offered the invocation. Mayor E. R. Giles led the pledge of Allegiance.

Town Clerk Cynthia Mallett called roll and the following were present: Mayor E. R. Giles, Council Members: David Hanks, Cindy LaPoint, Ellsworth Duhon, and Dorothy Charles; also attending were Town Attorney Bennett LaPoint, Town Clerk Cynthia Mallett; Chief of Police Cheryl Vincent. Absent was Kirk Conner.

Diane Savoie representing the traveling Vietnam Wall gave a presentation of the wall and announced that the wall will be in the City of Lake Charles in October. She asked for help on making this a successful event. She requested that organizations and businesses help with funds and volunteers. She thanked the Mayor and Council for allowing her to make this presentation and thanked them for any help they may be able to give.

It was motioned by Ellsworth Duhon, seconded by Dorothy Charles to adopt the agenda. The motioned carried unanimously.

It was motioned by David Hanks, seconded by Cindy LaPoint to approve minutes of regular meeting held July 2, 2008. The motion carried unanimously.

It was motioned by Ellsworth Duhon, seconded by Dorothy Charles to approve paying the bills. The motion carried unanimously.

It was motioned by Dorothy Charles, seconded by David Hanks to adopt Ordinance No. 521. The motion carried unanimously.

ORDINANCE NO. 521

AN ORDINANCE AUTHORIZING THE PUBLIC

AUCTION OF SURPLUS PROPERTY BELONGING

TO THE TOWN OF LAKE ARTHUR

WHEREAS, the Mayor and Board of Council Members for the Town of Lake Arthur, Louisiana have been advised that the Town presently owns certain movable and immovable property that is no longer of use to the municipality and are of the opinion that the sale of said property would be in the best interest of the municipality;

AND WHEREAS, the Town of Lake Arthur is authorized to sell surplus property under the provisions of Louisiana Revised Statute 33:4712;

THEREFORE, BE IT RESOLVED by the Mayor and Board of Council Members for the Town of Lake Arthur, Louisiana, that bids be received for the purpose of the sale of the following immoveable and moveable property, said sale to be advertised in the manner provided by law, with the Town of Lake Arthur reserving the right to reject any and all bids received, towit:

201 Pelican Street, known as the Senior Citizen Center, Lots 19, 20, 21, 22 Block 4 Live Oak Park Addition with buildings and improvements for a minimum bid of $70,000.00

2 life guard towers for a minimum bid of $25.00 per tower

1-1982 F600 Flatbed Truck with VIN 1FDNF60H5CVA04660 for a minimum bid of $500.00

1-1990 F700 Flatbed Truck with VIN 1FDNF70H8LVA18722 for a minimum bid of $400.00

1-Miller Welder Machine, Bluestar 2E-AC/DC for a minimum bid of $200.00

4-Westinghouse H-D 30AMP Switch for a minimum bid of $10.00 each

1-1999 Crown Victoria car with VIN 2FAFP71W6XX15640 for a minimum of $200.00

BE IT FURTHER ORDAINED by the Mayor and Board of Council Members that after due advertisement and acceptance of bids, that the Mayor be authorized and empowered to execute any and all bills of sale and other documents necessary to transfer title to the above mentioned property to the respective highest bidder.

After public hearing was held on the above ordinance, the title having been read and the ordinance considered, on motion by Dorothy Charles, seconded by David Hanks to adopt the ordinance, a record vote was taken and the following result was had:

YEAS: Dorothy Charles, David Hanks, Cindy LaPoint, and Ellsworth Duhon

NAYS: None

ABSENT: Kirk Conner

ABSTAIN: None

WHEREUPON, the presiding officer declared the above ordinance duly adopted on this 6th day of August, 2008.

It was motioned by David Hanks, seconded by Cindy LaPoint to approve the following resolution:

RESOLUTION

A RESOLUTION REQUESTING THE LOUISIANA STATE MINERAL BOARD TO ADVERTISE AND GRANT MINERAL LEASE PERTAINING TO ACREAGE PREVIOUSLY COVERED BY STATE AGENCY LEASE NUMBER 18633

WHEREFORE, the Town of Lake Arthur has been approached by the Roblyn Resources, Inc. to lease certain acreage previously covered by State Agency Lease Number 18633;

AND WHEREAS, the Town of Lake Arthur desires and requests the Louisiana State Mineral Board to handle the advertisement and possible subsequent granting of said lease on behalf of the Town of Lake Arthur;

NOW, THEREFORE, BE IT RESOLVED at a regular meeting of the Mayor and Board of Council Members of the Town of Lake Arthur meeting on August 6, 2008 that the Louisiana State Mineral Board is requested to handle the advertisement and possible subsequent granting of a mineral lease affecting the identical acreage previously covered by state agency lease number 18633 and more particularly described as Exhibit “A” attached hereto and made a part hereof.

IT IS FURTHER RESOLVED that Mayor E. R. Giles be authorized and empowered on behalf of the Town of Lake Arthur to execute any and all documents, including but not limited to mineral lease agreements, to effectuate the granting of this mineral lease.

Mayor Giles commented that last weekend the bands playing blue grass music were in the Lake Arthur Park and it was enjoyable. He said that they plan to come on a monthly basis. The Mayor also announced the Mayor, Council, Clerk, and Chief of Police will be attending the Louisiana Municipal Association annual convention in Lafayette on August 7th through the 10th to take in workshops.

It was motioned by David Hanks, seconded by Ellsworth Duhon to adjourn meeting. The motion was carried unanimously.
